On 5 October 2022, Decree 391/2022 of 28 September 2022 was published in the Official Gazette of the Principality of Andorra, approving the Regulations for the application of Law 29/2021 of 28 October on data protection (hereinafter, the “Regulations”), the purpose of which is to establish a regime adapted to the needs and peculiarities of the Principality of Andorra (hereinafter, “Andorra”).
The Regulation also determines and specifies the procedures and obligations of data controllers and processors of personal data introduced by Law 29/2021, of 28 October, on data protection (hereinafter, “LQPD”).
However, despite the intention to bring Andorran data protection regulations into line with the European framework regulation through the General Data Protection Regulation (EU) 2016/679 of 27 April 2016 (hereinafter, “GDPR”), there are certain inconsistencies that could ultimately compromise legal certainty in the field of data protection.
